    Fill in the basics. Start with the parties, campaign scope, and deliverables. If you can't describe the deliverables in one row each, the scope isn't clear yet.

    Price the rights separately. Complete the usage, whitelisting, and exclusivity clauses as their own line items. Each one limits what you can do later, so each one has a price.

    Compare against the brand's paper. If the brand sends its own contract, check it clause by clause against your term sheet. Mark every gap or difference before you reply.

    Get a legal review. Have a lawyer read the final agreement before you sign, especially for large fees, long usage terms, or exclusivity.

What should an influencer contract include?

At minimum: the parties, deliverables, timeline and approvals, payment terms, usage rights, whitelisting, exclusivity, revisions, FTC disclosure, cancellation or kill fee, termination, and a mutual morality clause. The term sheet in this template walks through each one.

Should I use my own contract or the brand's?

Larger brands usually send their own agreement. That's fine, but compare it against your term sheet line by line and ask for changes where it differs. Smaller brands often welcome a creator-drafted agreement. Either way, have a lawyer review it before signing.

What is a kill fee in an influencer contract?

A kill fee is what the brand pays you if it cancels the campaign after you've started work. It's often set as a percentage of the total fee that rises the further along the work is.
